Terms & Conditions of Service

These Terms & Conditions ("Terms") govern the purchase and delivery of design services from HEW Design ("HEW Design," "we," "us"). By purchasing a service, you ("Client," "you") agree to these Terms.

1. Services We Provide

HEW Design provides remote residential space planning and interior design services, delivered digitally. We currently offer:

- HEW Refresh — a fresh space plan using furniture and decor you already own, plus new furniture recommendations where they would genuinely help.

- HEW Renew — a full space plan using only what you already own, thoughtfully rearranged and refreshed, with no new furniture involved.

- HEW Review — a forthcoming service. Availability, scope, and pricing will be published before it is offered for sale.

The specific deliverables included in each service are described on the service page at the time of purchase. That description, together with these Terms, defines the scope of your project.

2. All Services Are Remote

​

All HEW Design services are performed remotely. We do not conduct in-person site visits, take measurements on site, supervise installation, or manage contractors or tradespeople as part of these services. Everything we produce is based on the information, measurements, and photographs you provide.

3. What You Are Responsible For

​

Because our work is remote, the accuracy of your project depends on the accuracy of what you give us. You agree to:

​

- Provide accurate measurements of your space, including room dimensions, ceiling height, window and door locations and sizes, and the locations of outlets, vents, radiators, and other fixed features.

- Provide clear, current photographs of the space from multiple angles.

- Provide accurate dimensions of any existing furniture you want kept in the plan.

- Disclose any known constraints — rental restrictions, HOA rules, building requirements, accessibility needs, allergies, pets, or anything else that would affect the design.

- Respond to questions within a reasonable time so your project can move forward.

- Independently verify all measurements and product dimensions before purchasing anything or beginning any physical work.

HEW Design is not responsible for design outcomes that do not work in your space because the information provided to us was inaccurate, incomplete, or out of date.

4. Turnaround Time

​

We begin work once you have submitted a completed project intake form and all information we have requested. Our target turnaround is 3-5 business days from that point for HEW Refresh and 5-7 business days for HEW Renew.

Turnaround times are estimates, not guarantees. If your project will take materially longer, we will tell you. The clock pauses whenever we are waiting on information or a decision from you.

5. Revisions

​

Each service includes one (1) round of revisions. A revision round means one consolidated set of change requests, submitted together, addressing the design we delivered.

​

Revisions are for refining the design we delivered — swapping a recommended piece, adjusting a layout, reworking a zone. A revision round does not include:

​

- Starting over with a new design direction.

- Changing the room, or adding a room, after work has begun.

- Changes required because the measurements or information you gave us were inaccurate.

- Changes requested after the revision window has closed.

​

Revision requests must be submitted within fourteen (14) days of delivery. After that, the project is considered complete. Additional revisions or out-of-scope changes are available at our then-current rate, quoted before any work begins.

6. Delivery

​

Deliverables are provided digitally, in PDF and/or image format, by email or through a link and/or attachment, to the email address you provide at checkout. Please keep your own copy. We will make reasonable efforts to retain project files for twelve (12) months, but we do not guarantee indefinite storage or re-delivery.

7. Product Recommendations

​

Where a service includes product or furniture recommendations, those recommendations are our professional opinion based on your space, stated budget, and preferences.

​

We do not take commission, affiliate revenue, or any other payment from brands or retailers on items we recommend. Our recommendations are not influenced by compensation from third parties.

​

We do not sell the products we recommend and we are not a party to any purchase you make from a third-party retailer. Pricing, availability, lead times, dimensions, color accuracy, quality, returns, and warranty are entirely between you and that retailer. Product prices and availability change constantly and we cannot guarantee that an item we recommend will still be available or priced as shown when you go to buy it.

8. Ownership and Use of Deliverables

​

HEW Design retains ownership and copyright in all designs, drawings, plans, renderings, mood boards, and other materials we create.

​

On receipt of full payment, you are granted a non-exclusive, non-transferable license to use the deliverables for the single residential space they were created for, for your own personal, non-commercial use.

​

You may not resell, redistribute, license, publish, or share the deliverables for commercial purposes, use them for a different property, or use them to produce designs for others, without our written permission.

​

9. Disclaimer of Warranties

​

Our services and deliverables are provided "as is" and "as available." To the fullest extent permitted by law, HEW Design disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our recommendations will achieve any particular aesthetic, functional, or financial result, or that deliverables will be error-free or uninterrupted.

10. Limitation of Liability

​

HEW Design provides design concepts, plans, and recommendations. We do not perform construction, installation, or contracting work, and we do not supervise those who do.

​

To the fullest extent permitted by law, HEW Design is not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our services or deliverables, including but not limited to property damage, personal injury, cost overruns, construction defects, delays, or losses arising from products purchased from third parties.

​

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to a project shall not exceed the total amount you paid HEW Design for that project.

​

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or fraud.

​

11. Indemnification

​

You agree to indemnify, defend, and hold harmless HEW Design, its owner, and its contractors and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) inaccurate, incomplete, or outdated information or measurements you provided; (b) your use of the deliverables, including any construction, purchase, or installation undertaken based on them; (c) your breach of these Terms; or (d) your violation of any law or the rights of a third party. This obligation survives completion of your project.

12. Cancellation

​

Cancellation and refund terms are set out in the Payment & Refund Policy, which forms part of these Terms.

​

13. Professional Conduct

​

We reserve the right to decline or discontinue a project, with a refund proportionate to work not yet performed, if a client is abusive, if the project falls outside our scope or expertise, or if we are asked to do something we believe is unsafe, unlawful, or contrary to these Terms.

14. Privacy

​

Information you provide is handled in accordance with our Privacy Policy. Photographs and project details are used to deliver your project and, subject to the Photo & Portfolio Release, may be used in our portfolio.

​

15. General Provisions

​

These provisions apply to the relationship between you and HEW Design generally.

​

- Force Majeure. Neither party is liable for delay or failure to perform caused by events beyond that party's reasonable control, including natural disasters, fire, illness, internet or utility outages, acts of government, or labor disputes.

- Independent Contractor. HEW Design provides services as an independent contractor. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between the parties.

- Electronic Communications and Signatures. You consent to receive communications from us electronically. Checking a consent box, clicking "I agree," or otherwise electronically accepting these Terms constitutes your signature and acceptance to the same extent as a handwritten signature, to the fullest extent permitted by the U.S. Electronic Signatures in Global and National Commerce Act and applicable state law.

- Eligibility. By purchasing a service, you represent that you are at least 18 years old and that you own the property at issue or otherwise have the legal right, including any necessary landlord, HOA, or co-owner permission, to request the changes contemplated by your project.

- Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a sale, merger, or reorganization of our business.

- Severability. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

- No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

- Entire Agreement. These Terms, together with the Payment & Refund Policy, the Design Disclaimer, the Photo & Portfolio Release (where applicable), and the service page description in effect at the time of purchase, constitute the entire agreement between you and HEW Design regarding your project, and supersede any prior discussions or representations, written or oral.

- Notices. Notices to HEW Design must be sent to info@hewdesign.co. Notices to you may be sent to the email address you provided at checkout and are deemed received when sent.

- Survival. The sections titled Ownership and Use of Deliverables, Disclaimer of Warranties, Limitation of Liability, Indemnification, this General Provisions section, and Governing Law survive the completion, cancellation, or termination of your project.

- Informal Dispute Resolution. Before filing a lawsuit, both parties agree to first attempt in good faith to resolve any dispute informally by contacting the other party and negotiating for at least thirty (30) days.

16. Changes to These Terms

​

We may update these Terms from time to time. The version in effect on the date of your purchase governs your project.

​

17. Governing Law

​

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Wake County, North Carolina.
